These Terms of Use ("Terms") govern your use of Tally, a web application operated by Dakota Labs LLC ("Dakota Labs," "we," "us," or "our") at tally.dakota-labs.com. By using Tally, you agree to these Terms.
1. Description of Service
Tally is a web application that calculates and presents life statistics based on your birthdate — such as the approximate number of heartbeats, breaths, days, and other milestone counts in your life. Tally also lets you ask questions and receive AI-generated custom life statistics. Some features are free; others require a one-time purchase to unlock.
Tally's statistics are estimates and approximations based on averages and general calculations. They are intended for entertainment and reflection — not medical, scientific, or actuarial advice.
2. Eligibility
You must be at least 13 years old to use Tally. By using Tally, you represent that you meet this requirement. Tally is not directed at children under 13.
3. Accounts
You may use Tally as a guest (no account required) or create an account to save your stats and preferences across devices. You are responsible for keeping your account credentials secure. Notify us at [email protected] if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are used in a manner that harms the service or other users.
4. One-Time Purchase & Refund Policy
Tally offers a one-time payment of $0.99 to unlock unlimited AI-generated custom stats (the "Unlock"). This is a one-time charge, not a subscription. The Unlock is tied to your account.
Refunds. Because the Unlock provides immediate access to digital content, all purchases are generally non-refundable. If you believe you were charged in error or experienced a technical problem that prevented access, contact us at [email protected] within 14 days of purchase and we will review your case.
Payments are processed by Stripe. By completing a purchase, you also agree to Stripe's terms of service.
5. Free Tier Limits
Without the Unlock, you may ask up to 2 free questions per account. Free users also have access to all pre-built life stat cards. The Unlock removes the question limit for your account.
We reserve the right to adjust free tier limits at any time. Existing paid Unlock holders will not be affected by changes to the free tier.
6. AI-Generated Content
Custom life statistics are generated using AI language models. AI output is creative and approximate by nature. Tally's responses:
- Are estimates based on averages, not individualized medical or scientific analysis
- May occasionally be inaccurate, unexpected, or nonsensical
- Are not medical, legal, financial, or professional advice of any kind
You use AI-generated content at your own discretion. Dakota Labs is not liable for decisions made based on Tally's output.
7. Acceptable Use
You agree not to:
- Use Tally to generate harmful, abusive, or illegal content
- Attempt to circumvent rate limits or access controls
- Scrape, reverse-engineer, or copy Tally's content or code without permission
- Use Tally in any way that violates applicable law
- Interfere with the service's infrastructure or other users' access
8. Intellectual Property
Tally and all its content, design, and code are owned by Dakota Labs LLC. You are granted a limited, non-exclusive, non-transferable license to use Tally for personal, non-commercial purposes.
Life statistics and AI-generated text that Tally produces in response to your questions are provided for your personal use. You may share them (e.g., as screenshots or downloads), but you may not resell or commercially exploit them.
9. Disclaimers
Tally is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that statistics will be accurate. Life statistics are fun approximations — treat them that way.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Dakota Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Tally. Our total liability to you for any claim arising from these Terms or your use of Tally shall not exceed the amount you paid us in the 12 months preceding the claim (in most cases, $0.99).
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of Tally after changes constitutes your acceptance of the updated Terms. For significant changes, we will make reasonable efforts to notify you.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in a court of competent jurisdiction.
